2. Filing a Notice of Infringement
If you believe content available through the service infringes your copyright, send a written notice to the designated agent that includes, per 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works;
- Identification of the material claimed to be infringing, with information reasonably sufficient to locate it (such as a URL);
- Your contact information, including address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf.
We may remove or disable access to the identified material pending resolution. Where content is removed, we make a good-faith attempt to notify the affected party so they may file a counter-notice.
3. Counter-Notice Procedure
If your material was removed and you believe it was misidentified or misremoved, you may file a counter-notice under 17 U.S.C. § 512(g)(3). The counter-notice must include: your physical or electronic signature; identification of the removed material and its former location; a statement under penalty of perjury that the removal resulted from mistake or misidentification; and your name, address, telephone number, and consent to the jurisdiction of a competent court for your district, and agreement to accept service of process from the original notifier. Valid counter-notices are forwarded to the original complainant; if they do not file a court action within 10 business days, the material may be restored.
4. Repeat Infringer Policy
In accordance with § 512(i), VoxFlow terminates, in appropriate circumstances, the accounts of customers and workspace holders who are repeat infringers. We also reserve the right to remove content and suspend workspaces for a single serious infringement pending investigation.
5. Abuse of This Process
Knowingly filing a materially false infringement notice or counter-notice may expose the sender to liability for damages, including costs and legal fees, under 17 U.S.C. § 512(f).
